01These terms
These terms apply when you use the Streamline missed-call service (the Service). They form a contract between you and Ramon Kordy trading as Streamline, ABN 77 469 869 723 ("we", "us", "our").
You agree to them when you submit the setup form or start using the Service, whichever happens first. If you're agreeing on behalf of a business, you're confirming you're authorised to do that.
We may update these terms. If a change materially affects you we'll give you at least 14 days' notice by email or text before it takes effect, and you can cancel without penalty in that period.
02What the Service does
When a call to your nominated mobile isn't answered, your carrier diverts it to a phone number we operate for you. We then:
- play a short recorded message to the caller and end the call;
- send the caller an SMS in your business name;
- exchange further SMS with them using an automated assistant to establish what the job is, how urgent it is and where it is;
- send you a summary by SMS so you can accept or decline; and
- tell the caller the outcome once you reply.
You keep your own phone number. Calls you answer never reach the Service.
03What the Service does not do
- It is not an answering service staffed by people. The SMS conversation is automated.
- It does not quote prices, confirm bookings or promise attendance times. Those are yours to give.
- It does not accept work on your behalf. No job is ever passed to a customer as accepted unless you reply to accept it.
- It does not guarantee you any volume of work. We make no representation about how many jobs you'll win, or what they'll be worth.
- It is not a monitored, emergency or life-safety service. See clause 6.
04Setting it up
To use the Service you'll need to set conditional call forwarding on your handset. We'll give you the codes. You can switch it off at any time, yourself, without telling us.
We rely on the details you give us in the setup form — your business name, the name used in texts, the numbers to divert and alert, the suburbs you cover, and the numbers to leave alone. Keeping those current is your responsibility. Tell us when something changes.
05Your responsibilities
- You hold any licence required for the work you take on, and the details you gave us are accurate and current.
- You authorise us to send SMS to people who call your number, in your business name, on your behalf.
- You are responsible for the work itself, for quoting it, for attending, and for everything you say to a customer directly.
- You will give us the numbers that should never be contacted — family, friends, suppliers — and keep that list current.
- You will not use the Service to send marketing messages, or for anything unlawful.
06Safety and emergencies
The Service is not an emergency service and is not monitored by a person.
If a caller describes something dangerous — sparks, smoke, a burning smell, exposed live wiring, an electric shock — the automated assistant tells them to stay clear, turn the power off at the switchboard if it is safe to do so, and that you are being alerted. It then flags the job to you as an emergency.
That is the whole of what it does. It does not call emergency services, does not stay on the line, does not confirm anyone is safe, and cannot assess risk. Messages may be delayed or fail for reasons outside our control.
Anyone in danger should call 000, or their electricity distributor's emergency line. You must not describe the Service to your customers as an emergency or after-hours response service.
You are responsible for deciding how quickly to respond to any job we pass to you, including ones flagged as urgent or as emergencies.
07Trial, fees and payment
The first two weeks are free. No card is required to start and the trial ends automatically — it doesn't roll into a paid plan unless you choose to continue by adding a card. We'll text and email you a secure link to do that near the end of the trial.
After the trial the Service is $199 per month, covering the dedicated phone number and all messages sent in normal use. There is no setup fee and no minimum term.
GST. Streamline is not currently registered for GST, so the price does not include GST and no GST is charged. If Streamline registers for GST, the price stays at $199 per month and from then on includes GST. We will tell you in writing before the first payment that includes GST, and from then on your receipts will be tax invoices showing the GST, so a GST-registered business can claim it back.
Fees are payable monthly in advance. If an invoice is more than 14 days overdue we may suspend the Service after giving you notice by email or text.
If your usage is far beyond ordinary — for example, bulk or automated traffic to your number — we'll talk to you before charging anything extra. We will never bill you more than your agreed monthly price in a month without your written agreement.
08Cancelling
You can cancel at any time, for any reason, by telling us in writing. We'll stop the Service and stop billing at the end of your current paid month. We don't refund part months.
You can also simply switch the call forwarding off on your handset, which stops the Service working immediately. That isn't a cancellation on its own, so let us know as well if you want billing to stop.
We may cancel by giving you 30 days' notice, or immediately if you breach these terms seriously, use the Service unlawfully, or don't hold a current licence.
09Availability
We'll make reasonable efforts to keep the Service running, but we don't promise it will be available without interruption. It depends on third parties including telecommunications carriers, messaging providers and artificial intelligence providers, none of which we control.
The Service is built to fail safe. If our systems are unavailable, calls to your number behave exactly as they would if you had never signed up — your phone rings, and unanswered calls go to your carrier's voicemail.
10Personal information
Running the Service means we handle personal information about the people who call you — their phone number and what they tell the automated assistant. We handle it in line with our Privacy Policy, which forms part of these terms.
We act on your instructions in relation to your customers' information. You confirm you have the right to give us the numbers you provide, including any numbers on your do-not-contact list.
We use third-party services located outside Australia to deliver the Service. Those are listed in the Privacy Policy.
11Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, including the consumer guarantees.
Because the Service costs well under $100,000, those guarantees apply to you even though you're a business — and they cannot be contracted out of. Any part of these terms that tried to do so would simply have no effect.
Where we're permitted to limit liability for a failure to comply with a consumer guarantee, our liability is limited to supplying the Service again, or paying the cost of having it supplied again.
12Liability
Subject to clause 11, and to the extent the law allows:
- our total liability to you in any 12-month period is limited to the fees you paid us in that period;
- we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of a job or customer, or reputational damage;
- we are not liable for anything caused by a carrier, messaging provider or other third party, or by you not setting up or maintaining call forwarding; and
- we are not liable for the electrical work you perform, or for anything you agree with a customer.
Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence.
13Indemnity
You indemnify us against claims, losses and costs arising from your breach of these terms, from the electrical work you carry out, from anything you tell a customer directly, or from you giving us a phone number you weren't entitled to give us.
This doesn't apply to the extent the claim was caused by our own breach or negligence.
14Confidentiality and intellectual property
We won't disclose your customer lists, pricing or commercial information to anyone else, or use them for anything other than delivering the Service.
We own the Service, the software behind it and everything we develop. You own your business name, your brand and your customer relationships. Nothing in these terms transfers either way.
We won't use your business name or logo in our own marketing without your permission.
15General
If part of these terms is unenforceable, the rest continues to apply. A delay in enforcing a right isn't a waiver of it. You can't transfer these terms to someone else without our agreement.
These terms are governed by the law of New South Wales, Australia, and both of us submit to the courts of that State.
